Comment on Flexible New Deal Provider Information by Kyron
My mother broke her arm so I had to catch the train and taxi. £5.90 for a train to wolverhampton and £7.00 for a taxi to beacon centre. I was asked about a job with the RNIB, as a trainee chef. Out of my field I thought, think about it, if we were a4e we would be reqiring you to apply for this. I didn’t reply, but thought thatsnot right. Ythey also mentioned to me again that I should perhaps move onto esa asit would not be so pushing and punative.and that they could work with me whilst on that. They also stated that I needed to fill out an application for sandwell PCT for a worksplacement.
I sopoke to the person who tookmy signing on booklet that some of my circumstances had changed and that a note would be sent upto mandy she might contact me back. Had noting as of 11/08/2010
I also printed out parts of the workfare scheme and they didn’t like what they saw especially.
It is very likely that a high proportion of those forced on to workfare will be disabled and
other disadvantaged people, who will be more likely than non-disabled people to reach the end
of the flexible New Deal without having obtained a job; workfare, in addition to all its other
drawbacks, thus has the potential to be discriminatory in its impact.
It is an extreme form of exploitation to require someone to work without pay and the TUC is
fundamentally opposed to compulsory unpaid work experience for extended periods in jobs
that would otherwise be taken by workers paid the rate for the job. This would exploit
THIS BITAs Paul Farmer, chief executive of Mind put it:
“We welcome the recognition that the voluntary sector has an important role to play in
helping people into employment, but our clients must always come first. Trust is one of the
voluntary sector’s unique selling points. We can’t betray people by getting involved in
compelling them into work before they are ready, or without the support they need.”

Comment on Social Security: JSA Benefit Sanctions are Unlawful! by Flexible New Deal
What are the ages of the children? I will research it on your behalf but to my understanding those with young children are almost exempt from sanctions because of fears from a knock on effect.
Also, what was the reason for the 2 week sanction?

Comment on Social Security: JSA Benefit Sanctions are Unlawful! by Flexible New Deal
If they sanction you: Make an Appeal including evidence of the jobs you have applied for and the steps you done to look for work.
You have to provide evidence – and must do 2-3 steps per week… it seems you would match that well.
You are not required to complete the booklet as such. It just your way of proving what you done to look for work. They cannot punish you for not filling in the book and for what you not done. They have to apply the positive test i.e. that you had done. Considering the circumstances, you couldnt prove what you did to look for work which gives them a valid reason to raise a doubt… however, now you have the evidence of what you actually did do… they must change their decision.
It is not an “error of law”: they clearly assumed that you couldnt provide evidence or particulars of your jobseeking activities because you didn’t do any. This isn’t true but you were on ESA, so do (did) you have a disability related to your failure to provide details (memory loss, learning difficulties etc.)? If so, then you might have a case in regards to them not being reasonable to your circumstances. This might be something you should remind them in your appeal.
Don’t worry at current: Doubt letters are something to be concerned about but not worried. It is when they send you an entitlement letter saying they cant pay you. It could be up to 6 months. You dont need to appeal yet because you have not lost any money.
Please See: http://www.flexible-new-deal.co.uk/2010/01/12/flexible-new-deal-esl48jp-entitlement-doubt-guidance/ (No one receives an ESL48 – its naughty really)
So they have requested information to help their decision? If so, make sure you respond with the evidence… and make sure you do it ASAP (dont rush it though) as they give you a silly deadline to comply. If you dont get a chance to make a comment then they will (99.9%) sanction you.

Comment on Social Security: JSA Benefit Sanctions are Unlawful! by dan
I got my first “doubt has arisen” letter today. I have been signing on for a few months and was on ESA before that. I guess I get no money for 2 weeks now? The letter also says “please see the enclosed leaflet ESL48. It is important that you read it. [second sentence in bold]“. Unsurprisingly, this leaflet was not included with my letter.
I applied for 4 jobs in the 2 weeks that the letter applies to and have proof for this (all were applied online or by email and took me a while as all required different applicaitons). My problem might be that I didn’t fill in the jobsearch booklet particularly well. Then, during my signing on, I was given a form to fill out which I couldn’t fill out because I didn’t have any of the details of the jobs in front of me. The advisor didn’t seem too bothered that I hadn’t filled it in and just asked me to bring proof next week. So I am a bit surprised.

It might be a good idea to write back to them and give them the evidence. They are only not requesting it to give them greater opportunity to sanction you. For the cost of a post stamp plus cost for paper and an envelope… if that saves your benefit it will help you. Of course, you are buying convenience, you wont be better off as you are having to spend money just to get your legal entitlement but its better then going through the appeal system.

Thanks for that. I didn’t fill in the booklet very fully (i.e. I missed out writing “Wait for a reply” after every application because it makes me feel like an idiot). I did roughly note the reference numbers from the job centre website, but the adviser wouldn’t let me use their computers to find the company names so I couldn’t fill in the second form properly.
The advisor also said that I “had refused a job search”. He asked “Do you want me to do a job search for you?” And I said “No thanks”, as the same 6 jobs show up every week. It was just a factual reply
The letter doesn’t ask for any evidence. Presumably that means I am getting a sanction? Is 2 weeks with no money the most they can do for a first “offence”? Or am I looking at months?

You mean the jobcentre wnat you to phone for an application, or is it a telephone interview?
You have two options: a) don’t bother phoning and tell the jobcentre you did OR b) phone and make sure sure you mess up the interview/application form – tell them the truth it being too far away from where you live.
I don’t see how the jobcentre can find out if you gor for a), thye’d be breaking the the Data Protrction Act unless you give the prospective employer permission to share your info with the jobcentre.
Good luck.

Comment on Enough is enough: complaint to New Deal Personal Adviser by deborah
two weeks ago i had not heard of pertemps ,then my husband reached the majic 52 weeks unemployed mark and since then my days have been filled with reading, complaining, researching (i myself reach 52 weeks and prospective slavery in november)
my complaints t PPDG about the language used to and treatment of my husband and the other clients in their offices, a detailed complaint to the jobcentre plus and a visited to my MP did result in the PPDG area manager wishing to meet with my husband and myself.PPDG accepted that their staff were at fault and that the issues would be addressed, although i myself would expect that this would require intensive training in social role valorisation priniciples ,to learn good manners ,and to have respect for the unemployed people who they treat with contempt and view as a subspecies.
imagine my horror to find that training is being used as a name for enforced labour ,slavery or as my husband puts it compulsory voluntary work.PPDG here in stoke on trent have mentioned that this glorious “training” will be litter picking and graffiti removal most likely( i thought that was used as punishment in this country when community service is the sentence)
so at age 50 , a graduate with 30 years experience and many NI and tax payments beneath my belt i shall look forward to litter picking, assisting me back into employment (ofcourse there have to be jobs available to be employed)
The pertemps trainers who earn £22511 per annum will have to prove to be working effectively or i will be asking for them to be sanctioned ie sacked,it seems only fair after all

Comment on Flexible New Deal dead already? by carol-ann
i started on flexible new deal 5 weeks ago. i came off incapacity to get a job but because i had a failed operation in 2006 which has damaged all the nerves in my right arm im finding it hard to get a job.
im also disabled with the chronic illness lupus which ive had for 14 years. my time on flexible new deal has not been a happy one, the best time was the induction since then everything has been downhill. ive been bullied by the caseworker as they call them, when she wasnt getting anywhere i was then taken to the manager and i had both of them bullying me, when i got home my husband said how did it go, and i burst out crying.
I have an action plan of i have to reply to 5 jobs a week, i dont have a car, and most of the local vacancies im not qualified to do so i dont know how i am supposed to achieve this, and know if you dont fill your joblog in properly they are going to stop your money.
All they can come up with, although i have experience in retail in their opinion they dont think im suited to this, but wait for this……………. in their opinion they think im more suited to care cleaning vomit and sh*t up, i havent spent years getting qualifications to put them in the bin, and i felt insulted at the suggestion, i then got threatened with a sanction of no money and i was being difficult.
And since then ive been called a liar, and a malinger, there is nothing wrong with me, so to prove my innocence i go to the hospital to see my consultant and hes appalled a how the way im being treated.
I have received an apology from the JCP but they havent done anything on FND that i could not have done at home or with the help of the JCP. in fact i feel more depressed since going there than i did being unemployed.
As for the placements that are on offer are for 4 weeks and they are in charity shops, which is really going to impresss employers NOT!
Like everyone thats unemployed i have been looking for a good quality job that has prospects, all FND have to offer, is something your not experienced at and dont have the skills and which you will be signing back on JSA in 4 weeks time. as the caseworker said to me they cannot help any of the unemployed till they get a job.
I dont know if the government are working on something as the JCP told me wait till 20 weeks does he know something i dont?
in the meantime im left their, but im applying for the jobs they give me, if i go and get it, and i injure myself my boyfriends said start personal injury claims.
I have done research on FND and this is the labour parties baby, and they have given the providers free reign to do what ever they like to us to get results. And we dont have anyone we can complain too, and if we try you get threatened to have your money taken away.
I hope this gets printed in its own entirety as i feel people need to be aware what FND is actually like, your not treated fairly or compassionately, your not matched with employers based on your skill and experience. they have a vacancy you can do it, thats the FND criteria.

Comment on Jobseekers Agreement by neelybee
I went for the re-arranged signing and have signed on again since. I am signing on every week at the moment, alternate weeks is a longer interview. This is normal after 3 months it seems. They had just brought the whole thing forward a week for some reason.
The job I didn’t want was not anything like the jobs I promised to go for. It was advertised as a “distributor” but the only vacancies left were canvassing double glazing door to door – so no falut on my part according to the Job Centre bloke who saw me. He seemed much more knowledgeable and reasonable than most.
Cheers

Comment on Sanctioned for not Actively Seeking Employment? by Firas
OMG now I’m really worried!! I’ve been on JSA for jut under 13 weeks, I received a letter from the Jobcentre asking for a meeting soon to discuss the next steps, I’ve been told this is where I become a on 2nd stage jsa and become entitled to New Deal. But now that I am hearing all the horror stories here I am so worried that they will sanction my benefits too. I mean I have been applying to jobs, but recently one of their advisers told me that I only have one job option and that is limiting my searches and that has to change, I wasn’t even ware there was only one, when I applied they asked me what I do and I answered!!
What’s going on in this country people? We pay our taxes for the Olympics and all that, and our people are starving because some snotty jobcentre adviser thinks they are not doing enough to get back to work?? How are you supposed to live if your only income is stopped, basically they are telling people to become criminals!!

Comment on Welfare Reform: Criticism by Trev Fairminer
I have a Blue Badge which my doctor supported me with. She filled in her report and sent it off, she signed to say ” I have a mobility impairment which makes it impossible, or virtually impossible for me to walk, considerations such as carrying parcels are not to be taken into account. The disability is permanent and not just spasmodic and is of a physical rather than a psychological nature.”
I also have a report from my GP This is a statement to say
“I also have osteoartritis in my right hip which is severe and stops me from walking”"The osteoarthritis is getting worse and he cannot walk more than 50 yards”
“Mr Fairminers disability means that he is unable to work”
However one of the Dodgy doctors in the pay of DLA, who never saw me walk anywhere, said I could walk 400metres. His report was fictitious, misleading and certainly not about me !! Because of this I have been fighting for 3 years to get the higher rate mobility. Tribunals keep harping on about this miraculous 400 metres walk, and refusing my appeal. I have e mailed every MP in the country. I have begun a campaign. For further info, look at my website.
